January is a month that typically makes you think of resolutions and fresh starts and positive outlooks as we welcome in the new year and begin 2026 with new goals – but for many, January is Divorce Month because a lot of people consider getting divorced during this month.
There is usually a big spike in divorce enquiries in January. At HLF Berry, this has certainly been our experience over the years as our family law solicitors provide guidance to more individuals and families seeking advice on divorce at the start of the year compared to other months.
In fact, not only is January known as Divorce Month, but the first working Monday after the holidays is known as Divorce Day due to the increase in divorce enquiries at this time.
It’s worth noting, however, that while the number of enquiries rise significantly during January, the number of divorce applications tend to remain fairly consistent throughout the year.
Why Does Divorce Spike In January?
The trend for increased divorce enquiries continues throughout January, which is why it’s often dubbed Divorce Month. In reality, though, divorce applications don’t actually spike in January normally – only the enquiries.
So why do more people consider divorce in the new year?
Every situation is unique, but as a guide we receive more divorce enquiries in January for reasons that include:

While it’s the most wonderful time of the year, Christmas puts families under pressure because of the extra costs and expectations to have a good time and make magical moments. - Timing
Especially where children are involved, families will wait until the festive period is over before enquiring about divorce. - New Year
January is a month of new beginnings and possibilities, and for some this includes a fresh start by divorcing their partner.
Why Pause This Divorce Month?
It’s important to remember that divorce isn’t always the right decision. Remember also that enquiries spike during January but not necessarily the number of divorce applications. The pressure, financial worries and exhaustion of the Christmas break can lead some to consider divorce – but often, there are alternative options for resolving marital difficulties.
Make sure you think it through and attempt other ways to resolve your current difficulties before filing for divorce.
